Terms of Service

Last updated: October 4, 2026

OVERVIEW

Welcome to Dr Monster!

The terms "we", "us" and "our" refer to Dr Monster. We operate this website and online store, including all related information, content, features, tools, products and services (collectively, the "Services"), to provide our customers with a convenient and enjoyable shopping experience.

Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service ("Terms"), together with our Privacy Policy, Return & Refund Policy and any other policies referenced herein, explain your rights and responsibilities when accessing or using our Services.

Please read these Terms carefully before using our website or purchasing our products.

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use our Services.

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law (ACL) or other applicable laws.

SECTION 1 – ACCESS AND ACCOUNT

By using our Services, you confirm that you are at least the age of majority in your state or territory of residence, or that you are using the Services with the consent and supervision of a parent or legal guardian.

When placing an order or creating an account, you may be required to provide information such as your name, email address, billing details, payment information and shipping address.

You agree to provide accurate, current and complete information and to update it when necessary.

You are responsible for maintaining the confidentiality of your account credentials and for activities conducted through your account, except to the extent that such activities result from circumstances for which you are not responsible.

If you become aware of any unauthorised access to your account, please contact us at hello@drmonster.com.au.

You may not transfer, sell or assign your account to another person without our prior written consent.

SECTION 2 – OUR PRODUCTS

We make reasonable efforts to ensure that all product descriptions, photographs, specifications, ingredients, packaging details and other information displayed on our website are accurate and up to date.

However, product colours and appearance may vary slightly depending on your device, screen settings and lighting conditions.

As our products may contain natural ingredients, minor variations in colour, texture or appearance may occur between batches. Such variations do not affect your rights under Australian Consumer Law.

We reserve the right to update product descriptions, packaging and specifications, discontinue products or limit purchase quantities where reasonably necessary.

Any changes to product specifications will not affect confirmed orders without an appropriate resolution in accordance with applicable law.

All products are subject to availability.

Our products come with guarantees that cannot be excluded under Australian Consumer Law, including guarantees relating to acceptable quality, fitness for purpose and conformity with their descriptions.

SECTION 3 – ORDERS

When you place an order through our website, you are making an offer to purchase the selected products.

An order is accepted when we confirm its acceptance. An automated acknowledgement of receipt does not necessarily constitute acceptance.

We may decline or cancel an order where reasonably necessary, including in circumstances involving:

  • Product unavailability.

  • Incorrect pricing or product information.

  • Suspected fraudulent or unauthorised transactions.

  • Payment processing failures.

  • Delivery restrictions or other circumstances that prevent us from fulfilling the order.

If we cancel an order after payment has been received, we will provide an appropriate refund in accordance with applicable law.

Please review your order carefully before submitting it.

If you need to cancel or modify an order, contact us as soon as possible at hello@drmonster.com.au.

If your order has not yet been packed or dispatched, we will do our best to accommodate your request.

Once an order has been dispatched, cancellation or modification may no longer be possible. You may still request a return in accordance with our Return & Refund Policy and your rights under Australian Consumer Law.

SECTION 4 – PRICES AND BILLING

All prices displayed on our Australian website are in Australian Dollars (AUD), unless otherwise stated.

Prices include GST where applicable. Any additional delivery charges will be displayed during checkout before you confirm your purchase.

Prices, discounts and promotional offers may change from time to time. Such changes will not affect orders that have already been accepted, except where otherwise agreed or permitted by applicable law.

We reserve the right to correct genuine pricing or billing errors. If an error affects an order you have placed, we will contact you to discuss the available options.

You agree to provide accurate and complete billing and payment information and confirm that you are authorised to use your selected payment method.

Payments are processed through Shopify or other authorised payment service providers, subject to their applicable terms and security procedures.

SECTION 5 – SHIPPING AND DELIVERY

We aim to process and dispatch orders within the timeframes stated on our website.

Delivery estimates are provided as a guide and may vary depending on your location, product availability, shipping carrier and other relevant circumstances.

While we make reasonable efforts to ensure timely delivery, delays may occasionally occur due to circumstances outside our reasonable control.

If your order is delayed, lost, damaged during transit or delivered incorrectly, please contact us at hello@drmonster.com.au so we can investigate and provide an appropriate solution.

We will handle any necessary claims with the shipping carrier where appropriate.

We remain responsible for meeting our obligations under Australian Consumer Law and other applicable laws. Nothing in these Terms transfers delivery-related risks to you in a way that excludes or restricts your statutory rights.

For further information about shipping arrangements, please refer to our Shipping Policy.

SECTION 6 – RETURNS, REFUNDS AND EXCHANGES

Our Return & Refund Policy forms part of these Terms of Service.

We offer a 14-day change-of-mind return policy for eligible products, subject to the conditions outlined in our Return & Refund Policy.

For change-of-mind returns, products must be unopened, unused, in their original packaging and in a resalable condition.

For health and hygiene reasons, we cannot accept change-of-mind returns for opened or used cat litter.

Customers are responsible for return shipping costs for change-of-mind returns. Original shipping charges are non-refundable, and no restocking fees apply.

Approved refunds will be arranged to the original payment method so that they are received within 14 calendar days of approval.

These conditions apply only to change-of-mind returns.

If a product is faulty, damaged, incorrectly supplied or otherwise fails to meet the applicable consumer guarantees, your rights and remedies under Australian Consumer Law will apply regardless of the ordinary return conditions.

Please refer to our Return & Refund Policy for full details.

SECTION 7 – AUSTRALIAN CONSUMER LAW

Our goods come with guarantees that cannot be excluded under Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Where a product fails to meet an applicable consumer guarantee, we will provide an appropriate remedy in accordance with Australian Consumer Law.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.

If any provision of these Terms is inconsistent with your non-excludable statutory rights, those rights will prevail.

SECTION 8 – PRODUCT USE AND SAFETY

Dr Monster products are intended for use as cat litter and should be used in accordance with the instructions and safety information provided on the product packaging or our website.

Please store products in a cool, dry place, away from moisture, and keep packaging materials out of reach of children and pets where appropriate.

We recommend following the product's usage and disposal instructions to maintain appropriate hygiene and performance.

If you have concerns about the suitability of a product for your pet, or if your pet experiences an unexpected reaction, discontinue use where appropriate and seek advice from a qualified veterinarian.

Nothing in this section excludes or limits any rights or remedies available under Australian Consumer Law, including rights relating to product safety, acceptable quality and fitness for purpose.

SECTION 9 – INTELLECTUAL PROPERTY

All content on our website, including text, graphics, illustrations, photographs, product images, packaging designs, logos, videos, audio, website layouts and other original materials, is owned by Dr Monster or used with the permission of the relevant rights holders.

Such content is protected by applicable Australian and international intellectual property laws.

You may access and use our website for lawful personal and non-commercial purposes.

You must not reproduce, distribute, modify, publish, commercially exploit or otherwise use our intellectual property without our prior written consent, except where permitted by applicable law.

The Dr Monster name, logo, product names, designs and other brand identifiers may be protected by applicable trademark and other intellectual property laws.

Nothing in these Terms grants you ownership of or a licence to our intellectual property, except as expressly stated or permitted by law.

SECTION 10 – OPTIONAL TOOLS

We may provide access to tools, applications or features operated by third-party service providers.

These tools may be subject to separate terms, conditions and privacy policies established by their respective providers.

We recommend reviewing the relevant third-party terms before using these services.

We do not control the independent operation of third-party tools. However, nothing in this section excludes or restricts any responsibility that we cannot lawfully exclude.

We may introduce new features, tools or resources from time to time. Where applicable, these will form part of our Services and be subject to these Terms.

SECTION 11 – THIRD-PARTY LINKS

Our website may contain links to third-party websites, social media platforms or other online services that are not operated or controlled by Dr Monster.

We do not control the content, availability or independent practices of these third-party websites.

We encourage you to review their terms and privacy policies before using their services or providing personal information.

Nothing in this section excludes any responsibility we may have under applicable law.

SECTION 12 – RELATIONSHIP WITH SHOPIFY

Dr Monster is powered by Shopify, which enables us to provide the Services to you.

However, any sales and purchases you make in our Store are made directly with Dr Monster.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Dr Monster, including any injury, damage, or loss resulting from purchased products and services.

You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Dr Monster.

SECTION 13 – PRIVACY POLICY

All personal information collected through our Services is handled in accordance with our Privacy Policy.

Certain personal information may also be processed by Shopify in accordance with its own privacy practices.

Because our Services are hosted by Shopify, information you submit may be transmitted to Shopify and authorised third-party service providers, including providers located outside Australia.

For more information about how we collect, use, store and disclose personal information, please review our Privacy Policy.

You can also review the Shopify Consumer Privacy Policy.

SECTION 14 – FEEDBACK AND REVIEWS

If you submit product reviews, suggestions, photographs, comments or other content to us ("Feedback"), you confirm that you have the necessary rights to provide that content.

You grant Dr Monster a non-exclusive, worldwide, royalty-free licence to use, reproduce, display and share your Feedback for purposes reasonably connected with operating, improving and promoting our products and Services, subject to applicable law and our Privacy Policy.

We will not use your personal information in connection with Feedback in a manner inconsistent with our Privacy Policy or applicable privacy laws.

You remain responsible for ensuring that your Feedback is accurate, lawful and does not infringe the rights of others.

We may moderate or remove Feedback where reasonably necessary, including content that is unlawful, abusive, misleading, fraudulent or infringes intellectual property rights.

We will not selectively remove or manipulate genuine customer reviews in a way that misleads consumers.

SECTION 15 – ERRORS, INACCURACIES AND OMISSIONS

Occasionally, information on our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, availability or delivery estimates.

We reserve the right to correct such errors and update information where reasonably necessary.

If an error materially affects an order that you have placed, we will contact you to discuss an appropriate resolution.

We will not make changes to confirmed orders in a way that unlawfully disadvantages you or removes your statutory consumer rights.

SECTION 16 – PROHIBITED USES

You agree to use our website and Services only for lawful purposes.

You must not:

  • Use our Services for fraudulent, unlawful or malicious activities.

  • Infringe our intellectual property rights or the rights of others.

  • Submit false, misleading or fraudulent information.

  • Harass, threaten, abuse or impersonate another person.

  • Distribute viruses, malware or other harmful code.

  • Attempt to gain unauthorised access to our website, accounts or systems.

  • Interfere with the security, functionality or operation of our Services.

  • Collect personal information about other users without appropriate authorisation.

  • Use our Services to distribute spam or other unauthorised promotional material.

  • Engage in unauthorised commercial exploitation of our website or its content.

We may take reasonable action to prevent misuse, including restricting access or suspending accounts where justified.

Nothing in this section restricts lawful activities that cannot legally be prohibited.

SECTION 17 – AUTOMATED TOOLS AND AI AGENTS

Automated software, bots, AI agents and similar technologies must not access or interact with our Services in a manner that compromises security, disrupts website functionality, violates applicable laws or circumvents reasonable technical restrictions.

Where applicable, automated agents must identify themselves and comply with any technical access requirements communicated by Dr Monster or Shopify.

We may implement reasonable technical measures to protect our website from unauthorised automated activity.

This section does not prohibit lawful search engine indexing, accessibility technologies or other automated access that we have authorised or that cannot lawfully be restricted.

SECTION 18 – TERMINATION

We may suspend or terminate access to our Services where reasonably necessary, including where a user materially breaches these Terms, engages in fraudulent activity or creates a genuine security risk.

Where appropriate and reasonably practicable, we will provide notice of the suspension or termination.

Termination of website access does not automatically cancel an accepted order or remove any existing rights or obligations.

Any outstanding orders, refunds or other matters will be handled in accordance with applicable law.

Provisions that are intended by their nature to survive termination, including intellectual property, liability and dispute-related provisions, will continue to apply to the extent permitted by law.

SECTION 19 – DISCLAIMER OF WARRANTIES

We make reasonable efforts to maintain the accuracy, security and availability of our website and Services.

However, we cannot guarantee that our website will always be uninterrupted, error-free or free from technical difficulties.

To the extent permitted by law, we do not provide additional warranties regarding the uninterrupted availability or operation of our website beyond those expressly stated or required by applicable law.

These limitations do not apply to any consumer guarantees, warranties, rights or remedies that cannot lawfully be excluded.

In particular, nothing in this section excludes or restricts your rights under Australian Consumer Law in relation to products or services supplied by Dr Monster.

SECTION 20 – LIMITATION OF LIABILITY

To the extent permitted by applicable law, Dr Monster will not be liable for losses arising solely from circumstances outside our reasonable control, except where we are otherwise legally responsible.

Nothing in these Terms excludes, restricts or modifies any liability, consumer guarantee, right or remedy that cannot lawfully be excluded under Australian Consumer Law or other applicable laws.

Where we are legally responsible for a failure to meet an applicable consumer guarantee, we will provide the remedies required by law, including any applicable compensation for reasonably foreseeable loss or damage.

Any limitation of liability under these Terms applies only to the extent that it is lawful, reasonable and enforceable.

SECTION 21 – INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify Dr Monster against reasonable losses, liabilities, damages and expenses arising directly from your unlawful conduct, intentional misconduct or material breach of these Terms.

This obligation applies only to the extent that the relevant loss or damage was caused by your conduct.

You will not be required to indemnify Dr Monster for losses caused by our own negligence, misconduct or breach of applicable law.

Nothing in this section excludes or restricts your rights under Australian Consumer Law or any other applicable law.

SECTION 22 – SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be severed to the extent necessary.

The remaining provisions will continue to apply, provided that they can operate lawfully and independently.

SECTION 23 – WAIVER AND ENTIRE AGREEMENT

Our failure to exercise or enforce any right under these Terms does not constitute a waiver of that right.

These Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy and any other applicable policies or conditions, form the agreement governing your use of our Services.

Nothing in this section excludes any rights, representations or remedies that cannot lawfully be excluded under applicable law.

SECTION 24 – ASSIGNMENT

You may not transfer your rights or obligations under these Terms without our prior written consent, except where permitted by applicable law.

We may transfer our rights and obligations where reasonably necessary for legitimate business purposes, provided that doing so does not materially reduce your rights or protections under these Terms or applicable law.

Where required by law, we will provide appropriate notice of such a transfer.

SECTION 25 – GOVERNING LAW

These Terms of Service are governed by and interpreted in accordance with the laws of Victoria, Australia, and applicable Commonwealth laws.

Subject to any rights you may have under applicable law, disputes arising in connection with these Terms may be brought before the courts of Victoria, Australia, and any courts with jurisdiction to hear appeals from those courts.

Nothing in this section excludes or restricts any mandatory consumer rights or legal protections available to you under Australian Consumer Law or other applicable laws.

SECTION 26 – CHANGES TO TERMS OF SERVICE

We may update these Terms from time to time to reflect changes to our business operations, Services or applicable legal requirements.

The most current version of these Terms will be available on our website.

Where required by applicable law, we will provide appropriate notice of material changes.

Changes to these Terms will not retrospectively alter the conditions of orders that have already been accepted, unless otherwise agreed or permitted by law.

Your continued use of our Services after updated Terms take effect constitutes acceptance of those changes to the extent permitted by applicable law.
